BNP faces financial turmoil if found in contempt of court

Nick Griffin could have his assets seized if high court rules that leader breached order to amend party's constitution

Fresh from its disastrous showing at the ballot box on 6 May, the British National party now faces financial turmoil with its assets threatened by court action. The high court is to decide whether Nick Griffin and two other BNP officials should face contempt of court proceedings in which their assets could be confiscated under a "writ of sequestration". The assets include Griffin's MEP salary, investments and pensions and any property that they might own. The case shows that no political party is above the law.

The contempt proceedings were brought by the Equalities and Human Rights Commission (EHRC) after the BNP was accused of failing to remove potentially racist clauses from its constitution. The BNP had been in breach of the Race Relations Act 1976 by admitting only white people to the party, but it revised its constitution in February to say it would allow people of any descent or origin to join, but only if the individual "agrees with or supports or does not oppose or does not disagree with the principles of our party".

However, the principles of the party in this amended constitution are still in terms of promoting indigenous over non-indigenous interests, including maintaining the "integrity of the indigenous British" and "restoring and maintaining" the indigenous British as "an overwhelming majority" (indigenous being defined by those that settled in these islands between 11500BC and 6 July 1189).

It is not difficult to see how this is contrary to the Race Relations Act 1976, because by signing up to the principles, any non-indigenous member would have to give up their racial and cultural identity. The BNP has also not changed its rule preventing new members from attending any party meeting until they have been interviewed by two BNP officials. A court in March ruled that this was intimidatory and directed against non-indigenous applicants.

If the high court rules that the BNP is in breach of the March order and gives permission to the EHRC to issue the writ, then it will appoint four commissioners. Two to three of the commissioners will be "authorised and commanded" to take possession of the BNP's assets. These assets will be kept in the hands of the commissioners until the BNP complies with the order to make its constitution free of racial discrimination.

Not only would this be a bitter pill for the BNP to swallow ideologically, it would also be financially punitive. A commissioner can cost up to £1,000 a day, and if the BNP has its assets confiscated, it will cost them up to £3,000 a day for those assets to be held. The BNP faces a period of financial turmoil.

  10. Interesting Newshound re: Galloway. The EDL video of the attack on the meeting looked like a complete shambles with the EDL running in and out of the venue like idiots.

    Still, the EDL have taken to attacking Left Wing meetings so the SWP should be careful at their big Marxism 2010 event in Central London next week. Although the SWP hate 'squadism' as it brings back bad memories from the early 80's, they should have security on the doors just in case.

I'm sure none of you would tolerate a mass of foreigners invading your lands which are still waiting there for your return. The British though have no where else to go. This is there land, not yours! It is strange that BNP get fixated with 6th July 1189 -apparently it is the death of Henry II, who was followed by Richard I betterknown as Richard the Lionheart who sepnt much of his time away. Cannot see why the BNP get fixated with this particular date but then again when you are 'several apples short of a lunchbox' and get worked in to a frenzy by the BNP propaganda machine- anything is possible and the earth becomes flat just like that.

    Henry II of England died on that date. Quite why is this is a big deal is beyond me and why should it mark somebody out as being non-British? Henry's successor was Richard the Lionheart who I would have thought the BNP would have been in favour of historically (he was both anti-Muslim and anti-Jewish)

    If I had the inclination to trace back my ancestry, it probably does meet the bizarre date criteria set by Griffin.

    It's not just immigrants and communists who despise right-wing nationalism, there's the vast majority of 'indigenous british' people like myself who think you're all cunts.

    A tiny minority exploits British society. 160,000 families, 0.3% of the population, own 37 million acres, two thirds of Britain, 230 acres each. Just 1,252 of them own 57% of Scotland. They pay no land tax. Instead every government gives them £2.3 billion a year and the EU gives them a further £2 billion. Each family gets £26,875.

    By contrast, 57.5 million of us pay £10 billion a year in council tax, a land tax, £550 per household. We live in 24 million homes on about four million acres. 65% of homes are privately owned, so 16 million of us own just 2.8 million acres, an average 0.18 acres each.

    Through the 18th century enclosures, the landowning class stole eight million acres from the people. They still hide their crimes and their takings. The 1872 Return of Owners of Land was made, but then hidden and never updated. Shares have to be registered; land doesn't. The Land Registry does not know who owns between 30 and 50% of land.

  21. Virtually no one in the party, members or supporters will give a penny to help Griffin; he will just have to get on with it. They are all busy looking for a new leader. Several names are being bandied about, and they will have nothing to do with the old Griffin cable. It’s a real turning point. My neighbor has been in the party for years, and she can’t stand Griffin.

    Start of the reign of Richard I (aka Richard The Lionheart). Doubt very much if this really is BNP policy, probably a throw-away line in some regional leaflet somewhere, but if it is then they really have gone out into la-la land in a big way!
